Terms & Conditions

Booking & Payment 

To secure your booking, a non‑refundable 50% deposit is required. Your booking is not confirmed until the deposit is received and your contract is signed.

Payment Details:

  • Remaining balance is due 14 days before the event.

  • Bookings made within 14 days of the event require full payment upfront.

  • Payments are accepted via bank transfer (details provided on your invoice).

  • Final photographs will not be delivered until full payment is received.

Late Payments: If payment is not received by the due date, the photographer reserves the right to cancel the booking and retain the deposit.

Minimum Notice: Bookings made close to the event date are subject to availability and may require full payment upfront.

Travel Fees: Travel fees may apply for locations outside Adelaide. These will be discussed and agreed upon prior to booking.

Overtime Fees: Events running beyond the agreed coverage time will incur overtime fees, charged at the rate outlined in your invoice or contract.

Cancellation, Rescheduling & Refund Policy

Client Cancellations:

  • All cancellations must be made in writing.

  • All cancellations forfeit the booking deposit.

  • Non‑COVID postponements require one week’s notice.

  • Date changes are treated as cancellations unless a mutually agreeable date is found within one month.

COVID‑19 Related:

  • Deposits may be transferred to a new date within one year.

  • COVID‑related cancellations forfeit the 50% deposit.

Photographer Cancellations: In the rare event the photographer must cancel due to illness or emergency, all payments will be refunded, or a replacement photographer may be arranged with client approval.

Rescheduling: Rescheduling is subject to availability. Additional fees may apply for last‑minute changes.

Weather Conditions: If weather prevents the session from proceeding safely, the photographer will reschedule at no additional cost.

Client Lateness: Late arrival reduces shooting time. Missed moments due to lateness are not the photographer’s responsibility.

Photographer Lateness: If the photographer is late due to unforeseen circumstances, additional time will be added to the session or a partial refund may be offered.

Copyright & Image Usage

Photographer Copyright: SunnyArchiveStills.co retains full copyright to all images created.

Client Licence: Clients receive a personal-use licence, allowing them to:

  • print images

  • share images with friends and family

Clients may not:

  • edit or apply filters

  • sell images

  • use images commercially

  • use images for business or promotional purposes without written permission

Photographer Usage: Images may be used for:

  • website

  • social media

  • portfolio

  • advertising

  • educational purposes

  • printed materials

Privacy Option: Clients may request that their images not be shared publicly. This must be communicated before the event or session, and outlined in the contract.

Model Release

By booking, clients grant permission for SunnyArchiveStills.co to use images for:

  • website

  • social media

  • printed materials

  • portfolio

  • advertising

Clients may opt out of public sharing for cultural, religious, or personal reasons. This must be requested in writing.

Image Delivery & Turnaround Times

Delivery Time: Final digital images are delivered within 6 weeks of the event date (excluding public holidays).

Sneak Peeks: Sneak peeks may be provided within 1–7 days depending on workload.

Delivery Method: Images are delivered via an online gallery with download access.

Gallery Availability: Galleries remain available for 6 months. Re‑delivery after expiry incurs a $150 archive fee.

RAW Files: RAW files are not included unless purchased as an add‑on.

RAW Files & Editing Style

  • RAW files are not released unless purchased.

  • RAW File Add‑On:

    • $200 if purchased before the event

    • $300 if requested after gallery delivery

  • Editing style is consistent, artistic, and final.

  • Clients may not request heavy Photoshop edits unless agreed upon.

  • No re‑editing by clients or third parties.

  • Retouching (skin smoothing, object removal, etc.) is provided, however any additional heavy retouching as an optional extra.

Photographer Responsibilities

The photographer ​agrees to:

  • deliver high‑quality images

  • attend the session on time

  • bring backup equipment

  • back up images safely

  • act professionally at all times

The photographer is not responsible for:

  • missed shots due to client lateness

  • restrictions imposed by venues or guests

  • interference from guests during events

Client Responsibilities

Clients agree to:

  • arrive on time

  • follow preparation guides

  • obtain location permits if required

  • inform the photographer of cultural or religious restrictions

  • ensure cooperation from guests

  • disclose any safety concerns at locations

Limitations of Liability

The photographer is not liable for:

  • injuries during the session

  • weather conditions

  • venue restrictions

  • equipment failure beyond control

  • lost images due to unforeseen disasters

If digital files are lost due to circumstances beyond the photographer’s control, liability is limited to a 50% refund. If loss occurs due to negligence, liability is limited to a full refund.

Force Majeure Clause

The photographer is not liable for failure to perform due to:

  • illness

  • natural disasters

  • extreme weather

  • government restrictions

  • emergencies

  • circumstances beyond control

If the session cannot proceed, it will be rescheduled or refunded depending on the situation.

Delivery Format & Printing Rights

Clients receive:

  • high‑resolution digital files

  • personal-use printing rights

The photographer is not responsible for print quality from third‑party labs. Professional prints may be purchased through the photographer.

Travel & Accommodation

Travel fees apply for locations outside Adelaide. Accommodation fees may apply for long-distance or multi-day events.

Second Shooter Policy

Second shooters may be added for an additional fee. Their availability is subject to scheduling and must be requested in advance.

Cultural Sensitivity Clause

The photographer respects all cultural and religious practices. Clients must inform the photographer of any restrictions or sensitivities prior to the event.

Film Photography Clause

If film photography is included:

  • film is unpredictable

  • colours may vary

  • scans may include grain or dust

  • no guarantee of specific film look

  • no refunds for film imperfections
